Welcome to eggs ! We have updated our terms for the upcoming ‘Map’ and ‘Whisper’ features. Please read this Agreement carefully, especially the clauses regarding disclaimers, user conduct requirements, and minor restrictions.

 一、用户资格与未成年人限制 / User Eligibility and Minor Restrictions

 1.1 年龄限制 / Age Restriction

本APP仅限年满16周岁以上的用户使用。我们不向未满16周岁的儿童提供任何社交服务。若我们在账号审核或日常运营中发现未满16周岁的未成年人账号,我们有权在不事先通知的情况下直接予以注销或封禁,由此产生的数据清除等后果由该用户及其监护人承担。

This APP is only available to users who are 16 years of age or older. We do not provide any social networking services to children under 16. If we discover any account belonging to a minor under 16 during account review or daily operations, we reserve the right to directly cancel or ban the account without prior notice, and the consequences such as data deletion shall be borne by the user and their guardian.

1.2 监护人同意 / Guardian Consent

16周岁以上未满18周岁的未成年人,应在监护人陪同下阅读本协议,并在获得监护人明确同意后方可使用本APP。

Minors aged between 16 and 18 shall read this Agreement accompanied by their guardians and may only use this APP after obtaining the explicit consent of their guardian.

 1.3 年龄验证机制 / Age Verification Mechanism

为落实年龄限制,我们采取以下验证措施:

– **手机号实名验证**:注册时需绑定经运营商实名认证的手机号,系统将校验号码持有人年龄信息;

– **身份证补充验证**:对于系统判定为高风险或疑似未成年人的账号,我们有权要求提供身份证号码或通过人脸核身进行二次验证;

– **持续监控**:我们将通过行为模式分析、内容偏好及举报线索持续评估账号实际使用人年龄,必要时启动重新验证。

To enforce age restrictions, we implement: mobile number real-name verification; supplementary ID or facial recognition verification for high-risk accounts; guardian confirmation via SMS/link for users aged 16-18; and continuous monitoring through behavior analysis.

二、地图与位置社交服务规范 / Map and Location-Based Social Service Rules

2.1 权限开启与关闭 / Permission Enablement and Disabling

蛋蛋eggs提供的地图社交功能(如查看附近好友、共享位置等)完全基于您自愿开启设备的精确地理位置权限。您可以随时在系统设置中关闭该权限,关闭后地图相关功能将无法使用,但不影响您使用其他核心功能。

The map-based social features provided by eggs (such as viewing nearby friends, location sharing) are strictly based on your voluntary enablement of your device’s precise location permission. You may disable this permission at any time in system settings; once disabled, map-related features will be unavailable, but it will not affect your use of other core features.

2.2 位置数据的存储与展示规则 / Location Data Storage and Display Rules

– **实时位置**:好友间的实时位置共享仅在双方均开启权限且处于活跃会话期间展示,关闭APP或退出会话后,实时位置更新将停止;

– **历史位置**:我们不存储您的历史轨迹数据,仅保留您最近一次上报的位置坐标(用于「附近好友」列表的距离计算),该数据将在7天后自动清除;

– **位置精度**:地图上显示的位置信息受网络环境、GPS定位精度及第三方SDK技术限制,可能存在一定的技术误差,仅供社交撮合参考;

– **免责声明**:我们仅提供地理位置的技术撮合与展示服务,不对用户之间在线下(真实世界)的见面、交往、线下活动的行为及后果承担任何形式的法律责任。用户应提高自我保护意识,谨慎对待线下社交,因线下交往产生的任何财产损失或人身伤害,由用户自行承担。

– **Real-time Location**: Shared only during active sessions while both parties have permissions enabled; updates stop when the APP is closed or session ends;

– **Historical Location**: We do not store historical trajectory data. Only your most recently reported coordinates are retained (for ‘nearby friends’ distance calculation) and automatically cleared after 7 days;

– **Accuracy Disclaimer**: Location information may contain technical errors due to network environments, GPS accuracy, and third-party SDK limitations;

– **Liability Disclaimer**: We only provide technical matching and display services for geographical locations, and shall not bear any legal liability for users’ offline meetings, interactions, or activities.

 2.3 禁止行为与处罚 / Prohibited Conduct and Penalties

严禁利用地图功能实施恶意尾随、跟踪、骚扰、非法偷拍、侵犯他人人身自由与隐私,或进行任何形式的非法集会与商业营销。一经发现,我们将实施永久封禁并依法向司法机关移交线索。

It is strictly prohibited to use the map feature to conduct malicious stalking, tracking, harassment, illegal secret filming, infringement of others’ personal freedom and privacy, or any form of illegal assembly and commercial marketing. Once discovered, we will implement a permanent ban and hand over clues to judicial authorities in accordance with the law.

2.4 申诉与复议 / Appeals and Review

若您认为我们对您的封禁处罚存在错误,可于收到处罚通知后30日内通过「我的-帮助与反馈-申诉」提交复议申请。我们将在收到申请后的15个工作日内完成审核并告知结果。申诉期间,原处罚决定不停止执行,但经复议确认错误的,我们将立即恢复账号并消除相关记录。

If you believe a ban was imposed in error, you may submit an appeal within 30 days via ‘Me – Help & Feedback – Appeal’. We will complete the review within 15 working days. The original penalty remains in effect during appeal, but will be immediately reversed if the appeal is successful.

 三、树洞(虚拟身份/匿名社交)使用规范 / Whisper (Virtual Identity/Anonymous Social) Rules

## 3.1 后台实名,前台自愿 / Real-name Backend, Voluntary Frontend

虽然树洞功能允许您换上可爱的「宠物身份」或以「匿名」形式在前端发布碎碎念、进行真心话大冒险等互动,但根据中华人民共和国相关法律法规,您必须绑定真实有效的手机号码并完成后台实名认证,方可使用发帖、评论及互动功能。

Although the Whisper feature allows you to put on a cute ‘pet identity’ or interact ‘anonymously’ on the frontend to publish posts or play Truth or Dare, in accordance with relevant laws and regulations of the People’s Republic of China, you must bind a valid mobile phone number and complete real-name authentication in the backend before you can use the posting, commenting, and interaction features.

3.2 实名信息的使用与保护 / Use and Protection of Real-name Information

– **用途限制**:您的手机号码、身份证信息(如有)仅用于后台合规审核、安全风控、违法信息溯源及监管部门依法调取,不会在前端树洞界面中展示给其他用户;

– **访问权限**:仅限经过授权的合规与安全团队成员在最小必要原则下访问,且访问行为将被审计日志记录;

– **存储期限**:实名信息将在您注销账号后的180天内删除,但法律法规要求保留的除外。

 **Purpose Limitation**: Your phone number and ID information (if applicable) are used solely for backend compliance review, security risk control, illegal content tracing, and regulatory inquiries, and will not be displayed to other users;

– **Access Control**: Only authorized compliance and security team members may access such information under the principle of least privilege, with access logged;

– **Retention Period**: Real-name information will be deleted within 180 days after account deletion, except where laws require retention.

3.3 内容禁止规范 / Content Prohibitions

用户在树洞内虽享有高度自由的表达空间,但严禁发布、传播包含以下内容的信息:

– 违反国家法律法规、危害国家安全与统一、破坏公序良俗的言论;

– 色情低俗、宣泄仇恨、恶意带节奏或引发群体对立的内容;

– 利用匿名身份针对特定个体实施网络暴力、人身攻击、诽谤、辱骂或恶意举报;

– 包含自残、自杀、自虐倾向或诱导、教唆他人自残自杀的灰色极端负面言论。

Although users enjoy a highly free expression space in the Whisper, it is strictly prohibited to post or disseminate information containing the following content:

– Speeches that violate national laws and regulations, endanger national security and unity, or destroy public order and good customs;

– Pornographic, vulgar, hate-venting content, or content that maliciously stirs up controversy or triggers group opposition;

– Using anonymous identities to implement cyberbullying, personal attacks, defamation, insults, or malicious reporting against specific individuals;

– Grey extreme negative speeches containing self-harm, suicide, self-abuse tendencies, or inducing/abetting others to self-harm or commit suicide.

 3.4 心理危机干预与免责 / Psychological Crisis Intervention and Disclaimer

本APP高度关切用户的身心健康。如我们在日常审核或用户举报中发现树洞内存在危及生命安全(如自杀/自残倾向)的内容,我们有权在法律允许的范围内采取必要的干预措施(包括但不限于限制发言、向有关部门报警、向监护人或紧急联系人披露信息等),且不承担侵犯隐私的责任。但我们不承诺对所有此类内容均能做到实时监测或成功干预,本APP不对任何因用户自身心理问题导致的意外事件承担法律责任。

This APP is highly concerned about the physical and mental health of users. If we find content that endangers life safety (such as suicide/self-harm tendencies) in the Whisper during routine review or user reporting, we reserve the right to take necessary intervention measures within the scope permitted by law (including but not limited to restricting speech, reporting to relevant departments, disclosing information to guardians or emergency contacts, etc.) without bearing liability for privacy infringement. However, we do not promise to achieve real-time monitoring or successful intervention for all such content, and this APP bears no legal liability for any accidents caused by users’ own psychological issues.

3.4.1 干预触发标准 / Intervention Trigger Criteria

我们将通过以下方式识别潜在心理危机内容:

– **关键词与语义模型**:系统自动检测包含自杀、自残、遗书、告别等敏感词汇及语义的内容;

– **用户举报**:其他用户通过「举报-涉及生命安全」渠道提交的线索;

– **行为异常信号**:短时间内发布多条极端负面内容、账号活跃度骤降等模式;

– **人工复核**:所有机器预警内容将由受过培训的人工审核员进行二次判断,避免误伤。

– **Keyword and Semantic Models**: Automated detection of sensitive vocabulary and semantics related to suicide, self-harm, farewell notes, etc.;

– **User Reports**: Reports submitted via the ‘Report – Endangers Life Safety’ channel;

– **Behavioral Anomaly Signals**: Patterns such as multiple extreme negative posts in a short time or sudden account activity drops;

– **Human Review**: All machine alerts undergo secondary review by trained human moderators.

3.4.2 分级干预措施 / Tiered Intervention Measures

– **一级(黄色预警)**:内容被暂时屏蔽,系统自动向发布者推送心理援助热线与平台关怀消息;

– **二级(橙色预警)**:限制该用户24小时内的发帖与评论权限,同时向紧急联系人发送提示短信(如用户已填写);

– **三级(红色预警)**:立即向当地公安机关报警,并配合提供该用户后台实名信息及近期活动记录。

– **Level 1 (Yellow Alert)**: Content temporarily blocked; automatic push of psychological support hotlines and platform care messages to the publisher;

– **Level 2 (Orange Alert)**: Posting and commenting restricted for 24 hours; alert SMS sent to emergency contact (if provided);

– **Level 3 (Red Alert)**: Immediate reporting to local public security authorities with provision of backend real-name information and recent activity records.

四、账号管理 / Account Management

4.1 账号注册 / Account Registration

– 您须使用真实、准确、完整且合法有效的手机号码完成注册,并设置符合安全要求的密码;

– 一个手机号原则上仅对应一个账号。我们有权对异常注册行为(如批量注册、虚假号码)采取限制或封禁措施;

– 您应妥善保管账号与密码,因您保管不善导致的盗号、冒用等后果由您自行承担。

4.2 账号注销 / Account Cancellation

– 您可通过「我的-设置-账号与安全-注销账号」发起注销申请;

– **注销条件**:账号处于安全状态(无被盗风险)、无未结清的虚拟财产或纠纷、无进行中的交易或处罚;

– **冷静期**:提交注销后,账号将进入7天冷静期。期间您可随时取消注销,账号恢复正常;冷静期届满后,注销正式生效;

– **数据处理**:注销生效后,您的个人信息将按照《隐私政策》第四条的规定进行删除或匿名化处理。请注意,您在树洞发布的公开内容(如帖子、评论)若已被其他用户截图或引用,平台无法控制其后续传播。

4.3 账号回收 / Account Recovery

– 注销后的账号名称、ID将进入冷冻期(90天),期间无法被重新注册使用;

– 注销后的数据原则上不可恢复,请在操作前备份您需要保留的内容。

五、知识产权 / Intellectual Property

## 5.1 平台内容 / Platform Content

本APP内的所有标识、商标、软件、界面设计、文字、图片、音视频及相关代码的知识产权均归属蛋蛋eggs或其授权方所有,未经书面许可,您不得复制、修改、传播或用于商业目的。

 5.2 用户生成内容(UGC)/ User Generated Content

– **权利归属**:您在树洞、地图动态或其他功能中发布的原创内容(文字、图片、语音等)的知识产权归您所有;

– **平台授权**:为运营本服务,您授予我们一项全球性的、免费的、非独家的、可转授权的许可,使我们可以存储、展示、传播、推广您的内容,以及为保护平台安全、打击侵权和违法内容而使用、处理该等内容;

– **内容合规承诺**:您保证您发布的内容不侵犯任何第三方的知识产权、肖像权、隐私权或其他合法权益。如因您的内容引发纠纷,由您自行承担全部责任;

– **违规内容处理**:对于侵犯他人权益或违反法律法规的内容,我们有权在不事先通知的情况下予以删除、屏蔽或断开链接,并视情节对账号采取处罚措施。

# 六、虚拟财产规则 / Virtual Property Rules

## 6.1 虚拟物品与服务 / Virtual Items and Services

– 如您使用本APP内的充值、打赏、会员订阅等服务,相关虚拟货币、道具、权益等属于虚拟财产,仅可用于平台内指定场景;

– 虚拟财产不可反向兑换为法定货币,不可转让、赠与或交易(平台允许的场景除外);

– 您应通过平台官方渠道进行充值,因使用非官方渠道造成的损失由您自行承担。

## 6.2 退款与争议 / Refunds and Disputes

– 除法律法规另有规定或平台存在过错外,虚拟财产一经购买或兑换,原则上不予退款;

– 如未成年人未经监护人同意进行大额充值,监护人可联系客服并提供相关证明材料申请退款,我们将依法依规审核处理。

# 七、协议变更 / Agreement Changes

我们可能根据业务发展或法律法规变化对本协议进行修改。修改后的协议将在APP内显著位置公示,并标注更新日期。对于重大条款变更(如服务内容、收费标准、责任限制、用户权利义务的重大调整),我们将通过弹窗、推送或短信等方式通知您。如您不同意变更后的协议,应停止使用本服务并注销账号;如您继续使用,视为同意修改后的协议。

We may modify this Agreement according to business development or legal changes. Material changes will be notified via pop-ups, push notifications, or SMS. If you do not agree, you should cease using the service and delete your account; continued use constitutes acceptance.

# 八、免责声明与责任限制 / Disclaimers and Limitation of Liability

 8.1 不可抗力 / Force Majeure

因不可抗力(包括但不限于自然灾害、战争、恐怖袭击、政府行为、网络攻击、电力或通信中断、第三方服务故障等)导致本服务中断、延迟或无法使用的,我们在法律允许的范围内不承担责任,但将尽力及时恢复服务并通知您。

8.2 第三方服务 / Third Party Services

本服务可能包含第三方提供的链接、SDK或服务(如地图、支付、分享等)。我们不对第三方的内容、隐私政策或服务质量承担担保责任。您与第三方的交易或纠纷应由您与第三方自行解决。

8.3 责任上限 / Liability Cap

除非法律另有强制性规定,我们对您因使用本服务而产生的直接损失的赔偿责任总额不超过您最近12个月内向我们支付的费用总额(如无付费记录,则以人民币100元为上限)。对于任何间接损失、预期利益损失、数据丢失或商誉损失,我们不承担赔偿责任。

九、争议解决 / Dispute Resolution

9.1 协商解决 / Negotiation

因本协议引起的或与本协议相关的任何争议,双方应首先通过友好协商解决。协商应在一方向另一方送达书面协商通知后30日内进行。

9.2 诉讼管辖 / Litigation Jurisdiction

若协商不成,任何一方均有权将争议提交至蛋蛋eggs运营方所在地(中国上海市浦东新区)有管辖权的人民法院诉讼解决。本协议的订立、效力、解释、履行和争议解决均适用中华人民共和国法律(为本协议之目的,不包括香港特别行政区、澳门特别行政区和台湾地区的法律)。

Any dispute shall first be resolved through friendly negotiation. If negotiation fails, either party may submit the dispute to the competent People’s Court at the location of eggs’ operator (Pudong New Area, Shanghai, China). This Agreement is governed by the laws of the People’s Republic of China (excluding Hong Kong SAR, Macao SAR, and Taiwan region for the purposes of this Agreement).

十、用户申诉与客服 / User Appeals and Customer Service

 10.1 客服渠道 / Customer Service Channels

如您在使用本服务过程中有任何疑问、建议或投诉,可通过以下方式联系我们:

10.2 投诉处理时限 / Complaint Handling Timeline

– 一般咨询:我们将在3个工作日内回复;

– 违规举报:我们将在24小时内确认受理,并在7个工作日内告知处理结果;

– 侵权投诉:我们将在收到合格通知后的3个工作日内完成初步审核,并视情采取删除、屏蔽等措施。

 10.3 外部救济 / External Remedies

若您对我们的处理结果不满意,您有权依法向网信部门、市场监督管理部门、消费者协会或其他有权机构投诉或举报。
